عقوبات رادعة للتصدي للإعلانات المضللة وخداع المستهلك …. في موسم الجمعة البيضاء
وجه جهاز حماية المستهلك بمناسبة تخفيضات الجمعة البيضاء، والتي تنطلق في الجمعة الأخيرة من نوفمبر الجاري، وتتسابق المحال التجارية لتقديم العروض والتخفيضات التي قد تصل إلى 70% على بعض المنتجات، وجه عدد من النصائح إلى المواطنين لتعظيم الاستفادة من موسم تخفيضات الجمعة البيضاء ، جاءت على النحو التالي:
–يجب أن يكون السعر المُعلن شامل الخدمة والضريبة
– يلتزم التاجر مُقدم الخدمة بأن يُعلن عن سعر السلعة التي يعرضها أو يقدمها للمستهلك شامل الخدمة و الضريبة.
ويعتبر (غير ذلك) مُخالفة لقانون جهاز حماية المُستهلك رقم 181 لسنة 2018.
كما حذر جهاز حماية المستهلك جميع التجار والمحال المشاركة في عروض” الجمعة البيضاء “من مخالفة القوانين أو تعمد غش المواطن بالإعلانات المضللة.
وطالب بضرورة الالتزام بالقانون وجدية العروض، حيث حدد قانون حماية المستهلك عقوبات رادعة للتصدي للإعلانات المضللة وخداع المستهلك قد تصل إلى غرامة قدرها 2 مليون جنيه.
ويعاقب قانون حماية المستهلك، كل من قام بغش المستهلك بالإعلانات المضللة، بغرامة لا تقل عن 30 ألف جنيه ولا تتجاوز 2 مليون جنيه، وفقا للمادة (9) من قانون حماية المستهلك رقم 181 لسنة 2018، والتي ألزمت المورد والمعلن بتجنب أي سلوك خادع كإعلان وجود تخفيضات على السعر على خلاف الحقيقة بما يؤدي إلى تضليل المستهلك.
وطالب التجار بالالتزام بالأسعار المعلنة وبالإعلان عن الأسعار قبل وبعد التخفيض، وكذلك الالتزام بتطبيق سياسة الاستبدال والاسترجاع المنصوص عليها في القانون خاصة خلال أيام التخفيضات.
ونصح بالشراء من الشركات والمحال الرسمية، والتي ولها مقار ثابته، خاصة عند التسوق الالكتروني، حيث يجب التعامل مع المنصات الرسمية للشركات والمعلنين التي لها مقار ثابتة، ليتمكن الجهاز من اتخاذ الإجراءات القانونية ضدهم في حالة التعدي على حقوق المستهلكين.

On the occasion of the White Friday sale, which starts on the last Friday of November, and shops are racing to provide offers and discounts that may reach 70% on some products , the Consumer Protection Agency directed a number of tips to citizens to maximize the benefit of the White Friday sale season, as follows:
-The advertised price must be inclusive of service and tax
– The merchant providing the service is obligated to announce the price of the commodity that he offers or offers to the consumer, including the service and tax.
It is considered (otherwise) a violation of the Consumer Protection Agency Law No. 181 of 2018.
The Consumer Protection Agency also warned all merchants and shops participating in the “White Friday” offers against violating laws or deliberately cheating citizens with misleading advertisements.
He called for the need to abide by the law and the seriousness of offers, as the Consumer Protection Law sets deterrent penalties to address misleadingadvertisements and consumer deception, which may reach a fine of EGP 2 mn.
The Consumer Protection Law punishes anyone who cheats the consumer with misleading advertisements with a fine of not less than EGP 30,000 and not exceeding EGP 2 million egp., according to Article 9 of the Consumer Protection Law No. 181 of 2018, which obliges the supplier and advertiser to avoid any deceptive behavior such as announcing the existence of price discounts contrary to the truth, which leads to misleading the consumer.
He called on traders to abide by the announced pricesand to announce the prices before and after thereduction, as well as to adhere to the application of the exchange and return policy stipulated in the law, especially during the days of sales.
He advised buying from companies and official stores, which have fixed headquarters, especially when shopping online, where they must deal with the official platforms of companies and advertisers that have fixed headquarters, so that the agency can take legal action against them in case of infringement of consumer rights.
